The Minister of Justice stirred up the fury of magistrates. 181 prosecutors and judges sent him a letter criticizing Tudorel Toader for his statements about the Public Ministry.
According to Digi 24, magistrates show their support to the General Prosecutor Augustin Lazar and to Prosecutors Division of the Superior Council of Magistracy (SCM).
181 prosecutors and judges signed this letter. Beside them, there are 29 auditors from the judiciary who express their dissatisfaction and concern over the recent statements by the Minister of Justice, regarding Tudorel Toader saying that the Public Ministry is deviating from its constitutional role.
„Minister, the undersigned, prosecutors and judges, by respecting the principle of the division of powers and the reserve requirement for magistrates, have taken note with concern of your allegations about the activity of magistrates and about the Public Ministry deviating from its constitutional role, as well as the recent announcement on the unexpected activation of the assessment procedure for the PICCJ Prosecutor General. Prosecutors who sign this letter express their support for the General Prosecutor of PICCJ, Mr. Augustin Lazar, as well as the position of the SCM Prosecutors Division, referring to the disservices that unfortunate assertions about the activity of the entire Public Ministry can bring the judiciary as a whole,” says the letter sent by the magistrates to Minister Tudorel Toader.
The letter, which was sent to Mediafax by Prosecutor Antonia Diaconu from Pitesti, started at the magistrate’s initiative, but the action is the result of a joint effort that colleagues from all over the country joined. One of the signatories is Prosecutor Andrei Bodean, candidate for chairing the DNA.
„Judges and prosecutors who signed underline that claims on the judiciary, issued by the Minister of Justice, can harm the society at large, both locally and internationally. We believe that, in the context of important criminal investigations that are underway and have a strong social impact, the position of official players must be balanced and responsible. Despite constant pressures exerted in the last year by mass media and representatives of political formations, we reaffirm our commitment to exercise our function by law and hope in a socio-political climate that allows for the aim of justice to be attained: finding out the truth and protecting citizens’ rights,” the letter said.
Magistrates invite Tudorel Toader to dialogue in order to find the best solutions for a judiciary system that serves the citizens: „We remind you that we fully respect your freedom of speech, materialized in opinions expressed in press statements and Facebook posts, but they have the downside of being unilateral, so they do not represent a constructive dialogue with the judiciary.”
Tudorel Toader made clarifications on Monday morning regarding the evaluation of Romania’s General Prosecutor Augustin Lazar announced two days ago. The Justice Minister said the decision regarding the evaluation has not come out of the blue or circumstantially.
