Mihaela Triculescu, new chief of ANAF

The National Agency for Fiscal Administration has publicly announced the start of the „Iceberg” operation – a large fiscal control action targeting big companies operating in all economic fields in Romania.

According to the press release issued by the institution, the control operation will take place throughout 2019 and officially involves „the intensification of controls and the efficiency increase in operating them within large companies with the aim of maintaining an equidistant treatment for all categories of taxpayers carrying out activities in Romania„.

What ANAF is after, according to the press release:

  • combating the phenomenon of the externalisation of profits
  • verifying the way in which large companies manage the economic relationships between companies within the group to which they belong
  • dispelling transactional chains organized to avoid meeting tax obligations
  • identifying and handling tax fraud phenomena that have significant negative fiscal effects on the state budget

„In order to achieve the objectives, ANAF has created a working team of specialists from the Agency that will initiate tax audits on taxpayers with impact activity in all fields of economic activity.


They will be based on the risk assessment of each taxpayer, in line with provisions of the Tax Procedure Code and relevant legislation in the field,” the press release mentions.

The National Agency for Fiscal Administration announced in April 2017 that it decided to delegate to its regional structures the competence of auditing 80 large taxpayers with high fiscal risk. The measure was taken following the conclusion reached at the central level finding that „almost half of the large taxpayers have not been audited during the limitation periods because of the lacking tax inspection capacity in previous years.”

Since 2015, the tax authority has a Department for audit of large taxpayers that seems to have had no special contribution in the tax collection process – the Court of Auditors’ public report on 2016 shows that the ANAF General Directorate for Large Taxpayers (DGAMC) did not carry out risk analysis within sensitive areas such as the companies authorized for gambling activities and did not recover any seizure in 2016.
